American officials have demanded that he is tried in the US despite ongoing wrangling between legal and medical experts about whether or not the 46-year-old would pose a suicide risk.
Theresa May, the Home Secretary, is expected to make a decision about whether to allow extradition by the end of July.
Cleary, the son of a college lecturer from Wickford, Essex, is alleged to have been a member of a hacking group called LulzSec and was charged with five offences under the Criminal Law Act and Computer Misuse Act, including an attack on the website of the Serious Organised Crime Agency.
He is accused of conspiring with three others to create a remotely-controlled network of zombie computers, known as a "botnet", which crashes websites.
Miss Todner, who also represents McKinnon, said that the decision to prosecute him in the UK was the right one and proof that it could be done.
“Cleary has always co-operated with British police on the basis that he would not be extradited,” she said.
“It is the proper application of law and shows that it is possible to prosecute here, so why isn’t it the same for McKinnon?
“British police arrested and interviewed McKinnon but then just decided to hand it over to the US.”
Miss Todner said no decision had been made about whether Cleary would deny or accept the charges but said that if any application was made for his extradition it would be “fiercely” contested.
"Mr Cleary suffers from Asperger's syndrome and is on the autistic spectrum and extradition to the United States is totally undesirable,” she added.
A US embassy spokesman said: “The US is not making any request of the UK regarding Ryan Cleary’s extradition at this time.”
The spokesman added: "No legal medical documentation or evidence has been officially presented to us to suggest that Mr McKinnon has a medical condition that should be taken into consideration in our request for his extradition."
Janis Sharp, McKinnon's mother, insisted he had been subjected to tests by five separate medical experts, all of whom were "supposed to be independent" and whom had diagnosed Asperger's and that he was a suicide risk and was unfit to stand trial in the US.

After a few weeks away lapping up the sunshine and filming his new reality TV show in Hollywood, California, Mark Wright has returned to British shores.
The dapper gent wasted no time in finding his feet and getting back to his old ways by heading straight to his favourite Essex nightclub, last night.
Following his night out, the 25-year-old looked in good shape as he appeared on This Morning, earlier today, and spoke about how his new holiday romance.

Mark dropped in to popular hangout Faces, in Essex, but didn't stay out too long because of his appearance on TV in the morning.
He tweeted: 'I'm being good. On the way home 2 my bed 4 the 1st time in 6weeks. Faces was great as per usual but I'm on this morning 2mo so have 2 b good.'
When he appeared on This Morning today, Mark spoke publicly for the first time about his relationship with Chelsea describing her as 'great'.

He said: 'It's a difficult one because she's got so many commitments out there, but we met, we had fun, but it was never meant to be like that.
'She's great, we got on so well. We started out as friends but then it developed into something else.'
The thing that Mark liked about his new girlfriend the most was that she had no idea who he was or why he was famous.
He said: 'She liked me for me because she didn't have a clue who I was.'

Mark hooked up with the U.S volleyball player while filming Mark Wright's Hollywood Nights, and the casual friendship developed into something more serious rather quickly.
The reality TV star was seen saying goodbye to Chelsea at LAX airport yesterday and looked very sad to be leaving her.
The ITV2 show didn't exactly receive great reviews when it aired for the first time last Sunday but viewers may be eager to tune in this weekend as the second episode will include how Mark and Chelsea first met.

Their romance is clearly more than just an onscreen film, as the pair of them appeared to be tearful as they said farewell outside the airport terminal.
Outside LAX, Mark - who was wearing blue skinny jeans and a white T-shirt - was seen hugging Chelsea and kissing her as she flung her arms around his neck.
She was also wearing dark jeans and a white T-shirt and gazed at the Essex-born star as he prepared to catch his flight back to the UK.
The pair have obviously become quite close over the past six weeks, and perhaps Mark is considering letting Chelsea visit his hometown some time soon.

London 2012: Kent councils budget £500,000 for relay - BBC News
Local councils in Kent will spend nearly £500,000 welcoming the Olympic torch as it passes through the county.
A BBC survey found budgets for the torch relay, which will be in Kent on 18, 19 and 20 July, varied from £750 in Gravesham to £210,000 in Maidstone.
Kent County Council will also spend more than £200,000 but has received grants from Olympics organiser Locog and the government to cover £120,000.
Kent will host two overnight stays, in Dover and Maidstone.
John Burden, leader of Gravesham Borough Council, said it was spending £750 of its taxpayers' money but had also received a grant from the government.

"It think it is excellent value for money. It is a very good event to be supporting," he said.
"We have to the local community doing food and entertainment and we have 50 volunteer marshals. It is a fabulous opportunity and people should go to see the torch."
Sandra Matthews-Marsh from Visit Kent said the Olympic torch was spending more time in Kent than any other county.
The tourism organisation has estimated the publicity and global coverage of the torch relay will be worth £324m over the next four years.
"We actually get the torch before it gets to London so I think the tension is going to mount as we get to that point," she said.
Andrew Bowles, leader of Swale Borough Council, said it estimated up to 20,000 people would visit Faversham to see the torch relay.
"I am absolutely convinced it will bring money into the local economy, if all those spend £10, which isn't very difficult," he said.
"It would be irresponsible for us to expect 20,000 people to turn up and not to spend the necessary money on first aid facilities, emergency car parking and crash barriers.
"We do have a duty of care."
Conservative-run Maidstone Borough Council said it had a budget of up to £210,000 but hoped to spend less.
Councillor Fran Wilson, leader of the Lib Dem opposition, said she believed the council should have been more frugal.
"I think we should have been a little bit more circumspect, but having said that. we are the county town so I would expect us to spend more than most other places," she said.

TOWIE gang out in force at wrap party - The Sun
Series five of the hit ITV2 reality show finished last month, but the cast were seen being reunited on Wednesday night in a one-off Marbella special.
Lydia Bright was spotted arriving at the bash sporting a new choppy bob and fringe.
Earlier the 21-year-old had tweeted: "Love my new hair, my hair guru did me well once again thank u @robertkirbyuk @sanrizzsalons rocking out the fringe at the Towie wrap party x."
Lydia, who wore an off-the-shoulder mustard yellow frock, also posed arm-in-arm with new boyfriend Tom Kilbey, 21.
And the blonde later tweeted a pic of herself with mum Debbie, who also attended the bash, with the caption: "Me and my beautiful mother at the Towie wrap party."
Joey Essex, 21, donned yet another daring outfit for the party, teaming a tiny pale blue jacket with a shirt and tie, jeans and brown boots.
But the discomfort of his super-tight blazer obviously didn't stop him from enjoying himself last night, he tweeted: "Towie wrap party = SICK."
And he later added: "Towie wrap party was fun. Nice to see everyone happy x."
Sam Faiers, also 21, arrived at the do with sister Billie.
The girls looked stunning as Sam matched an off-the-shoulder white top with a multi-coloured sequinned skirt and Billie, 22, flashed her ample cleavage in a clingy light green and gold-studded Lypsy dress.
Both sported skyscraper sling-back peep-toe heels to the do.
Sam later tweeted a snap of Billie pouting at the camera writing: "Aww @BillieFaiers."
The photo also showed off busty Billie's incredible assets.
This morning Billie tweeted: "Morning everyone :-) had a brilliant time at the wrap party last night .. For all those asking, my dress i wore was lypsy xx."
Boutique co-owner Sam also posted a pic of her kissing boyfriend Joey.
She captioned the cute snap: "Just got home from the wrap party .. A tad drunk ?? Great night x x."
Charlie King, 26, who was pictured hanging out with pals "Little Chris" Drake, 25, and Bobby-Cole Norris, 24, tweeted last night: "What a great evening with amazing people- night all Or good morning x."
Charlie and Little Chris went for a smart-casual look, teaming suit jackets with jeans.
While Bobby opted to go a little bit more upmarket in a bright blue suit.
Cara Kilbey posed for a pic with close friends Frankie Essex and Billi Mucklow.
But she revealed she wouldn't be hitting the booze with her castmates at the bash, she wrote: "Being a good girl tonight on the water... #oooOoooOooo #H20."
The girls, all 24, looked gorgeous in a series of glam frocks.
Gemma Collins, who stripped off to her swimsuit to tell love interest Arg "You ain't ever gonna get this candy" in The Only Way Is Marbs, missed the bash.
The 31-year-old tweeted: "Gutted to have missed the Towie wrap party tonight hope everyone had fun off to the airport soon xx."
Newly-engaged Mario Falcone and Lucy Mecklenburgh were also absent, as they are currently in Dubai.

The TOWIE model admitted it was hard being in a relationship that was played out on television but she said they now worked hard to spend quality time together away from the show, since rekindling their romance.
Sam said: "Me and Joey have been absolutely great. When we were together before, it was rushed and we didn't really make time for ourselves and our personal life. And this time TOWIE is TOWIE and the celebrity lifestyle, but when we get time together we just relax and we sit in and watch films.
"I think you need that in your relationship, because our lifestyles are so hectic, it's nice to actually sit down and relax with each other.
"Sometimes you feel under pressure, and other times it's fine. I think we're both looking forward to a nice holiday this year, just the two of us."
The reality TV star, who has released her autobiography, Living Life The Essex Way, also confessed it was tough having their arguments aired on TV for everyone to watch, but she had come to accept it was part of the job.
She said: "Some things like that you think 'I wish I could just deal with this myself with him'. But if it's out there it needs to be spoken about on the show otherwise it would look weird to the viewers. They'd think, 'Why are they all happy, what about them pictures we saw?', so you do have to play it out.
"Sometimes I wish some things could be kept between you both, but it has to be played out, because it's our lives and that's what we're on the show for."
She added: "It's hard to watch it back and hear myself shouting!"

ESSEX NATIONAL HERITAGE: Local lecture planned, new Vocational-Tech School underway, Spaulding Adaptive Sports Program and Chamber breakfast - Abington Mariner
These are some of the many activities going on as part of the Essex National Heritage Commission in June.
Endecott Pear Tree Lecture
The Essex National Heritage Commission, in collaboration with Mass General/North Shore Center for Outpatient Care and the Danvers Historical Society will present a lecture and visit to, the Endecott Pear Tree, deemed by the U.S. Department of Agriculture to be the oldest living fruit tree in North America. The evening program will take place on Tuesday, June 19 from 6– 8 p.m. at the Mass General/North Shore facility located at 102 Endicott St. in Danvers. The event is open to the public. Tickets are $5 for Essex Heritage and Danvers Historical Society members and $10 for non-members. Registration is required.
New Regional Vocational –Technical High School
I was particularly pleased that I was able to attend a recent presentation prior to Town Meeting when the leadership of the Essex County Vocational-Technical School visited for their annual presentation to the Town of Danvers Finance Committee. I was particularly pleased to learn of their exemplary record of student’s graduation results, the lack of students that drop out and the positive MCAS Testing results and many other general educational endeavors.
The current facility that houses the present Vocational School, the Essex County Agricultural School and Peabody Vocational School into a new almost 1,500 regional vocational school scheduled to open in 2014. Planning for that new school is well underway and the groundbreaking for that new building recently occurred in Danvers. Excavation is scheduled soon and as you drive up Route 62, as you approach Middleton, please watch as construction will soon begin. Danvers Finance Committee generally accepted all we heard about the school. There are many leaders in this region that have contributed their expertise to this endeavor, but none of them have contributed any more than the efforts expended by Wayne Marquis, the town manager of Danvers who oversaw much of the planning to be certain that this new facility will become a reality.
Spaulding Rehabilitation Hospital Program
The Spaulding network has released a comprehensive brochure that outlines a broad based adaptive sports program offered both regionally and at other locations across the state. The Spaulding network has been offering the adaptive sports program since 2001.
The hospital network that uses “Find your strength” as its motto, has organized a number of programs that will help achieve that stated goal. In the past, I have taken part in a cycling program offered through the Salem location and have participated in a golf program offered at Cape Cod. In 2012, I intend to once again participate in the hand cycling program in Salem and if possible will take advantage of the cycling program on the cape.
In Boston, this year programs offering participation in windsurfing, cycling, canoeing, kayaking, paddle boating, rowing, tennis, wall climbing, sailing and stand up paddling will be offered.
The Salem location will offer a program in water-skiing. That program will be managed and operated by my current therapist at Salem and the regional manager Kathleen Salas. The Cape Cod program that has been in place for over a decade adds Sports kite flying, golf instruction and fishing in addition to the other program offerings.
Both the Boston and the Cape program offer riding clubs weekly. North Shore Chamber Executive Breakfast Series
The Annual “State of the Region” breakfast by North Shore Municipal Leaders will be held early in June at the Peabody Marriott Hotel.
At this Executive Breakfast, each municipal leader has an opportunity to address one major issue in their community that will have an impact on the North Shore. They will address issues such as Economic Development, Regional Cooperation, Infrastructure Improvements, to name a few. Karen Andreas, Chairman of the North Shore of Chamber of Commerce will moderate this timely forum. This address offers a unique opportunity to learn what is happening in the Region.

Lydia Bright leaves her Essex co-stars in the shade at TOWIE wrap party - Metro.co.uk
She had clearly opted to spread her wings away from the usual Essex attire in favour of a more sophisticated look for the end of season party last night, held at Sugar Hut in Brentwood.
The mustard yellow dress ensured Lydia stood out from the crowd while her co-stars, including Sam and Billie Faiers, Cara Kibey and Billie Mucklow, faded into the background.
The off-the-shoulder piece, from Virgos Lounge, was cinched in at the waist and then fell around her hips with a slit up the middle. She teamed the outfit with a matching yellow clutch bag and nude heels.
But, as if the dress wasn't enough of a statement, Lydia also chose last night to show off her new shorter hairdo.
The blonde beauty was clearly chuffed with her new look as she beamed proudly while posing for photos with new boyfriend Tom Kilbey, the brother of her best friend Cara.
He opted for a much more casual look in blue denim jeans and a plain black T-shirt with matching leather jacket.
Faiers sisters Sam and Billie also turned plenty of heads at the party, but not because their outfits oozed sophistication or glamour.
Billie had opted for a pale green Lipsy dress covered in gold studs and although it wasn't the shorted frock she's ever worn out, the low-cut plunging neckline left little to the imagination.
As she posed for photographers outside the nightspot, at one point she seemed slightly concerned she was about to suffer a wardrobe malfunction as she peered down at her bust to check they were still covered up.
Sam also had her cleavage on show in a dress by Virgos Lounge. It featured a white top with off-the-shoulder straps and a brightly cooured sequin skirt.
Other stars that donned their glad rags for the evening included Billi Mucklow, Cara Kilbey and Frankie Essex.
James Argent also scrubbed up for the occasion, no doubt trying to grab Lydia's attention in a dapper dark grey suit.
Joey too added a splash of style to the evening in blue jeans matched with a whit shirt and grey tie, as well as a pale blue jacket.
Although he was smiling as he arrived at Sugar Hut, he undoubtedly had a bigger smile later on in the night after Sam posted a cosy picture of the pair enjoying a smooch.

Kent: Return of councillor who left malicious voicemail for bisexual colleague ‘an insult’ - pinknews.co.uk
A bisexual councillor in Kent has said it is ‘shocking’ that a Conservative colleague who told him he hoped he would ‘get Aids’ will rejoin his party’s team following a six-month suspension.
In May, independent councillor John Worrow received a voicemail from Conservative Ken Gregory which said: “With a bit of luck, you’ll get Aids.”
After a police investigation, Mr Worrow was cautioned for malicious communication and suspended from the Conservative group for six months.
But Mr Worrow told PinkNews.co.uk this afternoon there was anger at the prospect of Mr Gregory returning to the council at all.
Mr Worrow said: “Many residents feel that the decision for him to remain in the Conservative Party is an insult to those in the area who are living with HIV AIDS.
“On the same day as this shocking decision to allow Ken Gregory to rejoin the Conservatives in six months’ time, I received anonymous hate mail telling me I am going to hell for being bisexual.”
Mr Worrow said residents had called for a protest outside Thanet council offices on 12 July at 6pm, an hour before a public council meeting that Mr Gregory is attending, to call for him to resign.
The Conservative group leader had not responded to a request for comment on Mr Gregory’s suspension by the time of publication.
Thanet District Council became the first local authority in Kent to support equal marriage rights for gay couples in April. It was the second council in England, after Southwark, to affirm such a position.
